Terms of Service

These terms are the agreement between Yallery, Inc. (“YalleryLabs”, “we”) and you, for the use of the YEngine generation API and the console at dashboard.yallerylabs.com (together, “the Service”). By creating an account or calling the API you accept them.

1. What the Service is

The Service generates images, video and related media from the inputs you send it. You address it with an API key, you are billed per call, and there is no subscription. Model names, prices and accepted parameters are published at the API reference and returned by GET /v1/models.

We may add, change or retire models. A model id that has been published keeps working, or keeps answering under its previous name after a rename; we will not silently point an existing id at a different model.

2. Your account

You must be at least 18 years old and able to enter a contract. You are responsible for what happens under your account and your API keys, including calls made by anyone who obtains a key from you. Keys can be revoked at any time from the console; do that immediately if one leaks.

We store only a hash of each API key, so we cannot recover one for you — a lost key is replaced, not retrieved.

3. Money

The Service is prepaid. You add credit, each call debits your balance at the published price for the parameters you sent, and a call that cannot be covered is refused with HTTP 402 before anything is generated. Payments are processed by Stripe; we never see or store your card number.

Failed generations are refunded in full, automatically. If a job fails on our side, the amount reserved for it returns to your balance without you asking.

Unused credit is refundable. Write to [email protected] from the address on the account and we will return the unspent balance to the original payment method. Credit already consumed by completed generations is not refundable — the compute has been bought and spent.

Prices can change. A change applies to calls made after it is published; it never re-prices a call you have already made.

4. Your content

You keep every right you had in what you send us. You grant us only the permission we need to run the Service: to receive your inputs, process them, store the results, and deliver them back to you.

We do not use your prompts, inputs or outputs to train models, and we do not show them to anyone. We do not sell them, and we do not use them as examples without asking you first in writing.

You are responsible for having the rights to what you send. Do not upload material you do not have permission to use, and do not use the Service to produce:

We may refuse or stop a call that appears to breach this section, and we may suspend an account that repeatedly does. Where we can, we will tell you why.

5. Availability

We do not offer a service level agreement. The Service runs on GPU capacity we rent, and both capacity and latency vary: a warm worker answers a 720p clip in about 20 seconds, while the first call after a quiet period can take a few minutes. Published timings are measurements, not promises.

We will not deliberately break a working integration. Breaking changes to the request or response shape are avoided; when something must change, the old behaviour keeps working.

6. Suspension and ending the agreement

You can stop using the Service at any time and ask for your unused balance back. We can suspend or close an account for a breach of section 4, for non-payment, or where required by law. If we close an account that has not breached these terms, we refund the unused balance.

7. Liability

The Service is provided “as is”. Generated output is produced by machine learning models and may be inaccurate, unsuitable for your purpose, or resemble existing material; you are responsible for reviewing it before you use it, and for how you use it.

To the extent the law allows, our total liability for any claim relating to the Service is limited to the amount you paid us in the three months before the claim arose, and we are not liable for indirect or consequential loss, lost profit, or lost data.

Nothing here limits liability that cannot be limited by law.

8. Changes to these terms

We may update these terms. If a change materially reduces your rights, we will email the address on your account at least 14 days before it takes effect, and you may close the account and take your unused balance instead of accepting it.

9. Law and disputes

These terms are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-law rules. Before starting any formal proceedings, write to us — most things are settled by an email.
